LEGAL FRAMEWORK FOR CYBER-INDUCED PROVOCATION IN NIGERIA: CHALLENGES AND THE NEED FOR LEGAL REFORMS

Abstract
The advent of digitalisation, followed by the rapid spread of internet usage and technological
aptitude has transformed human interaction, allowing instant communication and bridging the
gaps in time and space. However, despite this benefits, there has been the manipulation of digital
platforms to perpetrate all forms of cybercrimes, thereby inducing provocation. This study
examined the application of cyber-induced provocation as a defence within Nigeria's legal and
criminal law frameworks. The objectives of the study were to assess the nature of provocation
within the Nigerian criminal law, identify the legal and institutional frameworks for cyber
induced provocation and highlight the challenges and possible prospects that may be realized in
addressing cyber-induced harms in Nigeria. This study adopted a doctrinal research
methodology, drawing data from primary and secondary sources such as cases and scholarly
commentary, as well as domestic, regional and international instruments. This study found that
there are currently no cyber-specific regulations or laws that address online provocation. This
study concluded, by recommending the reformation of the Cybercrimes Act and the establishment
of a legal framework that provide for cyber-induced provocation as a legal defence in face of
cyber-induced harms
