Legal Regulation of Halal Industries in Nigeria: Opportunities, Challenges and Lessons from other Jurisdictions

Abstract

Nigeria, home to an estimated Muslim population of over 100 million, constitutes one of Africa’s largest halal consumer markets and possesses significant potential to participate in the rapidly expanding global halal economy. Notwithstanding this strategic advantage, the country lacks a comprehensive statutory framework for halal regulation, relying instead on a fragmented system of general consumer protection laws, food safety regulations, standards enforcement mechanisms, and private Islamic certification bodies. The paper examines the existing legal and institutional architecture governing the halal industry in Nigeria, with particular attention to the regulatory roles of the National Agency for Food and Drug Administration and Control, the Standards Organisation of Nigeria, the Federal Competition and Consumer Protection Commission, and private halal certifiers. Through a comparative analysis of established halal regulatory models in Malaysia, Indonesia, Saudi Arabia, the United Arab Emirates, and Australia, and by situating the discussion within the broader framework of international trade law, including the WTO Agreement on Technical Barriers to Trade and the African Continental Free Trade Area (AfCFTA), the study identifies the principal opportunities and challenges shaping Nigeria’s halal sector. It asserts that achieving economic diversification, export competitiveness, and regional leadership in the global halal market requires comprehensive legal reform, the establishment of a centralised National Halal Regulatory Authority, and harmonisation with internationally recognised halal standards. The paper concludes with legislative and policy recommendations aimed at strengthening regulatory certainty and positioning Nigeria as a credible participant in the global halal economy.
